1. Agreement
These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and getaisales, Inc. ("getaisales", "we"). By creating an account or using the Service, you agree to these Terms.
2. The Service
getaisales provides AI-powered sales automation for WhatsApp and Meta Ads, including a multi-tenant dashboard, CRM, conversation routing, and AI message generation (the "Service"). We may modify features at any time, with reasonable notice for material reductions.
3. Accounts
- You must be at least 18 and authorized to bind your organization.
- You're responsible for the activity under your account and for keeping credentials secure.
- Notify us immediately at security@getaisales.com of suspected unauthorized access.
4. Subscriptions and billing
- Paid plans are billed in advance, monthly or annually, in USD.
- Trial periods are clearly stated at signup; you will not be charged during a trial.
- You may cancel at any time; cancellation stops future billing but does not refund the current period unless required by law.
- Overage usage (e.g., AI messages above plan limits) is billed at the rates posted on our Pricing page.
5. Acceptable use
You agree not to:
- Send spam, phishing, scams, or content prohibited by Meta or WhatsApp Business policies.
- Use the Service to violate laws (consumer protection, anti-spam, sanctions, IP, etc.).
- Attempt to reverse-engineer, scrape, or overload the Service.
- Use the Service to build a competing product.
We may suspend accounts that violate these rules, with notice where feasible.
6. Customer content
You retain ownership of all content you upload, import, or generate in the Service ("Customer Content"). You grant us a limited license to host, transmit, and process Customer Content solely to operate the Service for you.
7. AI outputs
AI-generated messages are provided as suggestions or auto-replies. You are responsible for reviewing AI behavior, calibrating prompts, and complying with disclosure laws (e.g., where required to disclose AI use to the recipient).
8. Third-party integrations
The Service connects to Meta, WhatsApp, Stripe, and other third-party platforms. Your use of those platforms is governed by their own terms. We are not responsible for their availability, pricing, or policy changes.
9. Confidentiality
Each party will protect the other's confidential information with the same care it uses for its own (no less than reasonable care) and use it only to perform under these Terms.
10. Warranty disclaimer
The Service is provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or appropriate for every situation.
11. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages. Each party's aggregate liability under these Terms is limited to the fees paid by Customer in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify getaisales against third-party claims arising from your Customer Content or your violation of these Terms or applicable law.
13. Termination
Either party may terminate for material breach not cured within 30 days of notice. We may terminate immediately for serious violations (fraud, abuse, illegal activity). On termination, your access ends and your data is retained for 30 days for export, then deleted.
14. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Disputes will be resolved by binding arbitration in Wilmington, DE, except that either party may seek injunctive relief in court for IP claims.
15. Changes
We may update these Terms from time to time. Material changes will be communicated to account admins at least 30 days in advance.
